GIFT CARD TERMS AND CONDITIONS

1. GENERAL TERMS

   Five Guys Gift Cards are issued by ­­­­­­­­­­­­­­­­­Five Guys HK Limited, a Hong Kong limited company ("Five Guys"). By purchasing a Five Guys Gift Card, you agree that the laws of Hong Kong, without regard to principles of conflict of laws, will govern these Gift Card terms and conditions ("T&C").

   These T&C are subject to change without notice. We reserve the right to alter all or any part of these T&C at any time and you should review the T&C regularly.

2. USING YOUR GIFT CARD

   Five Guys Gift Cards are redeemable at any participating Five Guys restaurants in Hong Kong.

   Five Guys Gift Cards are available for purchase in store. No fees of any kind will be imposed on purchasers of Five Guys Gift Cards in connection with the sale of Five Guys Gift Cards.  

   Five Guys Gift Cards are not refundable and may not be exchanged for cash. Five Guys Gift Cards have no value unless redeemed.

   No cash change shall be given on any purchases made using a Five Guys Gift Card.

   Purchase in excess of the balance of Five Guys Gift Cards may be settled with cash, credit card, e-commerce payment system or another Five Guys Gift Card.   

   Five Guys Gift Cards will be purchased in Hong Kong Dollars with a minimum balance of HK$ 100 and a maximum value of HK$ 1,000.

3. EXPIRY

   Five Guys Gift Cards shall be valid for twenty-four (24) months from the date of its activation. Upon expiry, any balance remaining on a Five Guys Gift Card will be reduced to nil and forfeited such that the Five Guys Gift Card will no longer have any value capable of being used or redeemed in any participating Restaurants.

4. VIEW YOUR BALANCE

   To view your balance please go to a participating Five Guys restaurant in Hong Kong to make a request.

5. RETURNS

   You may not return or cancel your Five Guys Gift Card after it is purchased.

6. CORRUPTED, DELETED, LOST, STOLEN, DESTROYED, DAMAGED OR USED GIFT CARDS

   If you suspect that someone has copied or stolen your Five Guys Gift Card, visit a participating Five Guys location in Hong Kong immediately. Five Guys Gift Cards will not be replaced if lost or stolen. Five Guys Gift Cards have cash value and should be safeguarded accordingly.  

   If a Five Guys Gift Card is corrupted, deleted, lost, stolen, destroyed or damaged or used without permission, Five Guys shall not be responsible. Five Guys reserves the right to refuse to accept a Five Guys Gift Card which we deem to have been duplicated, tampered with, damaged or otherwise suspect has been affected by fraud.

   Five Guys shall not replace a Five Guys Gift Card if corrupted, deleted, lost, stolen, destroyed or damaged or if it is used without permission.

7. INTELLECTUAL PROPERTY RIGHTS

   Any and all intellectual property rights in the Five Guys Gift Cards are owned by Five Guys and all such rights are reserved.

8. LIMITATIONS

   You may not use a Five Guys Gift Card to purchase other Five Guys Gift Cards.

   Five Guys Gift Cards cannot be reloaded, resold, transferred for value, or redeemed for cash, except to the extent required by law. Void if reloaded, resold, transferred for value, or redeemed for cash. Unused Five Guys Gift Cards may not be transferred.

   Total purchases for any one individual may not exceed HK$ 100,000 in one calendar day.

   We reserve the right to terminate your order for any Five Guys Gift Card if we believe you are in breach of these T&C or if we suspect fraudulent activity. We also reserve the right to refuse to take any order in a participating Restaurant if we believe you (or the person placing the order) have breached any of these T&C or if we suspect fraudulent activity.

   You shall not use any Five Guys Gift Card except in accordance with these T&C and shall not use any of the same for any purpose which is either illegal or prohibited under these T&C.
